These terms and conditions (hereinafter, the “Agreement” or “Terms and Conditions” or “Terms”) constitute a contract between you (hereinafter, the “User”) and FINAMI, regarding the use of the application service in Venezuela and Argentina (hereinafter, the “App”). The User agrees to read, understand and accept all the conditions established in this Agreement, at the time of requesting registration as a User of the App. If you do not agree with the Terms and Conditions, please refrain from using and/or installing the App. These Terms and Conditions will be considered accepted from the moment the User installs the App on their mobile device.

1. OBJECT: The App allows the User to manage and monitor the products and use the services offered by FINAMI that are described in (hereinafter the “Services”). The application allows you to manage your budget, pay bills, set financial goals.

2. COMMUNICATIONS: All communications related to the modification of these Terms and Conditions will be sent to the User through the App and/or to the email address indicated at the time of registration in the App.

3. MEANS OF USE: The Services are provided over the Internet through the App, through the use of mobile devices owned by the User.

4. REQUIREMENTS FOR USE OF THE APP: The User must have a mobile device with Internet access, have completed the registration satisfactorily and be approved by FINAMI in accordance with the linking policies of FINAMI. clients. The User may operate from any mobile device on which the App has been downloaded after having registered said device in the FINAMI system by the means provided for this purpose. 5. VALIDITY: Any transaction carried out from the App through the User profile will be understood to have been carried out personally by the User, considering them as valid, legitimate, authentic and binding, without the need to carry out another type of confirmation.

6. DATE OF OPERATIONS: All operations carried out by the User through the App will be recorded on the date and time in which they are actually ordered. In certain cases, the date or time of registration of the operation may be after the moment in which its execution has been requested through the App, depending on the type of operation.

7. IRREVOCABILITY: The User releases FINAMI from all responsibility for the operations carried out through the App, and guarantees to hold FINAMI harmless for any claim, damage and/or harm derived directly or indirectly from the use of your profile or the Keys in the App. Financial Responsibility: 7.1 The application does not assume responsibility for financial decisions made by users. 7.2 All information provided by the application is for informational purposes and does not constitute advice financial.

8. PROOF OF OPERATIONS: The User accepts that the orders given by him through the App will be taken as proof of his willingness to have carried out the operations personally. The User expressly accepts the information about your use of the Services that arises from the magnetic and/or electronic media provided by FINAMI through the App and/or the special means that FINAMI provides.

9. USER BREACHES: The App and its Contents may only be used for lawful purposes. FINAMI specifically prohibits any use of the App and its Contents to: - Provide fraudulent information, incomplete biographical data, false or inaccurate either during the registration process or at any time during the validity of the contractual relationship with FINAMI; - Refusing to provide any information, documentation or justification of any action, required by FINAMI. Using any mechanism to prevent or attempt to prevent the proper functioning of the App and/or its Contents. - Reveal or share the Keys with third parties, or use the Keys for unauthorized purposes. - The use or attempted use of any machine, software, tool, agent or other mechanism to navigate, search or violate the security of the App, the FINAMI Account, the Services or the Contents other than the search tools provided by FINAMI in the App. - Attempt to decipher, decompile or obtain the source code of any software program. FINAMI reserves the right to suspend or cancel any profile that, in its sole discretion, does not comply with the standards defined in this document, without generating the right to any compensation.

10. MEASURES IN CASE OF NON-COMPLIANCE: FINAMI may execute or carry out a series of measures ('the Measures') in order to protect and safeguard its rights, employees and Users, as a consequence of the materialization of the situations described in section 9 of this document, or at the exclusive discretion of FINAMI. The Measures may be, without being understood as an exhaustive list: (i) require that the User justify, and even provide support for any use or operation carried out from the App that is considered unusual, suspicious, fraudulent, or in bad faith, with the objective of protecting FINAMI and/or its affiliates and/or subsidiaries and/or controlling and/or controlled and/or linked and/or or partners and/or shareholders and/or managers and/or administrators and/or directors and/or officers and/or employees and/or dependents and/or representatives and/or representatives and/or legal representatives and/or advisors and/or any other natural or legal person that could be related to it, (ii) proceed to cancel the profile of any User or prevent the User's access to the App for the time that FINAMI considers necessary to analyze and resolve the situation and without generate FINAMI any liability. In turn, FINAMI reserves the right to initiate appropriate complaints and legal actions against the User; (iii) terminate, in the event of breach by the User, this Contract and the other contracts that the User has with FINAMI, and consequently cancel the profile of the User in the App that breaches these Terms and Conditions and/or there are suspicions of violation. of regulatory precepts for which FINAMI must respond.

11. CONFIDENTIALITY: Available on Android, the User's profile is completely confidential, and personal disclosure to third parties by the User is prohibited. In the event that the User becomes aware and/or suspects regarding a violation of the confidentiality of their information, they must notify it immediately. In case of loss or theft of the device, the User must give timely notice to FINAMI in order to carry out the corresponding blocks. In any case, if a third party carries out operations using the User profile, they will be considered valid, successful and binding and may only be objected if there is a failure attributable to FINAMI.

12. INTELLECTUAL AND INDUSTRIAL PROPERTY: The contents of the App, such as text, information, graphics, images, logos, brands, computer programs, databases, designs, APIs, functional architecture and any other material (hereinafter, 'the Content'), are protected by applicable laws, including, but not limited to, the laws on copyright, patents, trademarks, utility models, industrial designs and domain names, are whether or not they are registered, in the country or abroad. All Content is property of FINAMI and/or any other affiliated company, subsidiary, branch, agency, representations, controlling, controlled, linked companies and any natural or legal person that could be related to FINAMI and its content. The compilation, interconnection, operation and arrangement of the contents of the App is the exclusive property of FINAMI and/or its related companies. The User is authorized to use, view and print the elements of the App for your personal and non-profit use, refraining from carrying out any act of decompilation, reverse engineering, modification, disclosure or supply. The unauthorized use, adaptation, reproduction and/or commercialization of the Content may be punished by current legislation. The User will not copy or adapt the programming code developed by, or on behalf of, FINAMI to generate and operate the App or the Services, which is protected by applicable and current legislation.

13 RESPONSIBILITIES: The User declares and accepts that the use of the App, the FINAMI ACCOUNTS, the Services and the Contents is carried out under his sole and exclusive responsibility. FINAMI reserves the right to suspend and/or interrupt the service under criteria of security, maintenance, technical reasons, force majeure, fortuitous event or any reason that is beyond the control of FINAMI. FINAMI DOES NOT ASSUME ANY RESPONSIBILITY FOR THE OPERATION OF THE DEVICE AND/OR THE SOFTWARE USED BY THE USER TO ACCESS THE APP, THE CONTENTS AND/OR THE SERVICES, AS WELL AS WITH RESPECT TO THOSE RELATED AND/OR CAUSED BY THIRD PARTY SERVICE PROVIDERS OF INTERNET ACCESS, CELLULAR TELEPHONY. Available on Android and ANY OTHER SERVICE PROVIDED BY PERSONS OTHER THAN FINAMI. IN NO EVENT WILL FINAMI BE LIABLE FOR ANY DAMAGES INCLUDING, BUT NOT LIMITED TO, DIRECT AND/OR INDIRECT DAMAGES, LOST PROFITS AND/OR LOSS OF CHANCE RESULTING FROM THE USE AND/OR INABILITY TO USE THE APP , THE SERVICES OR THE CONTENTS, WITHOUT PREJUDICE TO WHETHER FINAMI HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. FINAMI EXCLUDES ALL RESPONSIBILITY FOR DAMAGES OF ANY NATURE THAT MAY BE DUE TO THE ACTION OF UNAUTHORIZED THIRD PARTIES WITH RESPECT TO THE PERSONAL DATA OF USERS, AS WELL AS THE CONTENT AND SERVICES OFFERED THROUGH THE APP.

14. PERSONAL DATA PROCESSING POLICY: The personal data processing policy is detailed in the FINAMI Privacy Policy contract.

15. LINKS TO THIRD PARTY SITES: The App may contain links to third party websites and/or applications (hereinafter, the “Third Party Sites”). FINAMI does not endorse or guarantee the contents of these Third Party Sites. FINAMI is not responsible for the content of Third Party Sites and makes no representations regarding the content and/or accuracy of these Third Party Sites. If you decide to access Third Party Sites, you do so at your own risk.

16. MODIFICATION OF THE SERVICES: FINAMI reserves the right to add, modify, restrict and/or delete all or any of the Services provided through the App, temporarily or definitively, without these measures being the subject of any requirement, nor of the right to claim damages or losses on the part of the User. However, FINAMI will inform the User if any of the events described in this section occur through push notification in the App and/or via email.

17. MODIFICATION OF THE TERMS AND CONDITIONS: FINAMI may modify these Terms and Conditions at any time by previously notifying the User of the changes via email and/or push notification in the App with an expression of the date of the last modification. All modified terms will be effective on the date indicated in the notification.

18. ASSIGNMENT OR UNAUTHORIZED COMMERCIAL USE: The User agrees not to assign, under any title, its rights or obligations under this Agreement. The User also agrees that it will not make any unauthorized commercial use of the App, the Services or the Contents. Likewise, the User undertakes to use the App, the Content and the Services diligently and in accordance with the applicable and current law and with this Agreement. FINAMI reserves the right, at its discretion sole discretion, to use all legal means at its disposal in the event that the User violates any of these Terms and Conditions.

19. ADDRESS. APPLICABLE LAW. COMPETITION. These Terms and Conditions are governed by the laws of the Bolivarian Republic of Venezuela. Any action derived from these Terms and Conditions or the use of the App must be subject exclusively to the jurisdiction of the Bolivarian Republic of Venezuela, the parties waiving any other jurisdiction or jurisdiction that may apply. If any of the clauses of this Agreement are declared null, such nullity will not affect the validity of the remaining ones, which will maintain their full validity and effect.
